Section 8 Notice: Can You Proceed with Lower Arrears?

I issued a rent arrears notice, but since then, the arrears have gone down as 2 of the three tenants have paid. So when the notice period ends at the end of this month, the arrears figure will be less than when it was issued. The question is, would I be able to go to court? Also, the two-month arrears will materialise again next month, and court proceedings can be issued.
